أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ يَحْيَى، عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِي هُرَيْرَةَ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ ‏

"‏ أَيُّمَا امْرِئٍ أَفْلَسَ ثُمَّ وَجَدَ رَجُلٌ عِنْدَهُ سِلْعَتَهُ بِعَيْنِهَا فَهُوَ أَوْلَى بِهِ مِنْ غَيْرِهِ ‏"

It was narrated from Abu Hurairah that the Messenger of Allah said:

"If a person becomes bankrupt, then a man finds the goods that he sold to him with him, he has more right to them than anyone else."

Al-Sindi — Hashiyat al-Sindi on Sunan al-Nasa'i

قَوْله ( أَيّمَا اِمْرِئِ ) كَلِمَة مَا زَائِدَة لِزِيَادَةِ الْإِيهَام وَامْرِئٍ مَجْرُور بِالْإِضَافَةِ ( أَفْلَسَ ) يُقَال أَفْلَسَ الرَّجُل إِذَا صَارَ إِلَى حَال لَا فُلُوس لَهُ أَوْ صَارَ ذَا فَلْس بَعْد أَنْ كَانَ ذَا دَرَاهِم وَدَنَانِير وَحَقِيقَته الِانْتِقَال مِنْ الْيُسْر إِلَى الْعُسْر قِيلَ الْمُفْلِس لُغَة مَنْ لَا عَيْن لَهُ وَلَا عَرَض وَشَرْعًا مَا قَصُرَ مَا بِيَدِهِ عَمَّا عَلَيْهِ مِنْ الدُّيُون ( ثُمَّ وَجَدَ رَجُل ) أَيْ بَعْد أَنْ بَاعَهَا مِنْهُ وَلَمْ يَقْبِض مِنْ ثَمَنه شَيْئًا كَمَا فِي رِوَايَة الْمُوَطَّأ عِنْد مَالِك ( فَهُوَ أَوْلَى بِهِ ) أَيْ بِذَلِكَ الَّذِي وَجَدَ مِنْ السِّلْعَة أَيْ يَجُوز لَهُ أَنْ يَأْخُذهُ بِعَيْنِهِ وَلَا يَكُون مُشْتَرِكًا بَيْنه وَ…

Samura reported the Prophet as saying, “If anyone finds his actual property with someone he has most right to it, and the buyer must sue the one who made the sale.” Ahmad, Abu Dawud and Nasa’i transmitted it.
