أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ، قَالَ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، قَالَ أَنْبَأَنَا شُعْبَةُ، عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، عَنِ الْقَاسِمِ بْنِ مُخَيْمِرَةَ، عَنْ عَمْرِو بْنِ شُرَحْبِيلَ، عَنْ قَيْسِ بْنِ سَعْدِ بْنِ عُبَادَةَ، قَالَ

كُنَّا نَصُومُ عَاشُورَاءَ وَنُؤَدِّي زَكَاةَ الْفِطْرِ فَلَمَّا نَزَلَ رَمَضَانُ وَنَزَلَتِ الزَّكَاةُ لَمْ نُؤْمَرْ بِهِ وَلَمْ نُنْهَ عَنْهُ وَكُنَّا نَفْعَلُهُ ‏.‏

It was narrated that Qais bin Sa'd bin 'Ubadah Said:

"We used to fast on 'Ashura and give Zakatul-Fitr, and when the command to fast in Ramadan was revealed, and the command to give Zakah was revealed, we were neither commanded to give it, nor told not to do so, and we used to do it."

قَوْله ( لَمْ نُؤْمَرْ بِهِ وَلَمْ نُنْهَ عَنْهُ وَكُنَّا نَفْعَلهُ ) الظَّاهِر أَنَّ الْمُرَاد سَقَطَ الْأَمْرُ بِهِ لَا إِلَى نَهْيٍ بَلْ إِلَى إِبَاحَة وَالْأَمْر فِي ذَاته حَسَنٌ فَفَعَلَ النَّاسُ لِذَلِكَ وَهَذَا بِنَاء عَلَى اِعْتِبَار بَقَاء الْأَمْر السَّابِق أَمْرًا جَدِيدًا وَاعْتِبَارُ رَفْعِ ذَلِكَ الْبَقَاءِ رَفَعَ الْأَمْرَ فَقِيلَ لَمْ نُؤْمَرْ بِهِ وَلِذَا اِسْتَدَلَّ بِهِ مَنْ قَالَ إِنَّ وُجُوب زَكَاة الْفِطْر مَنْسُوخ وَهُوَ إِبْرَاهِيم بْن عُلَيَّة وَأَبُو بَكْر بْن كَيْسَانَ الْأَصَمّ وَأَشْهَب مِنْ الْمَالِكِيَّة وَابْن اللَّبَّان مِنْ الشَّافِعِيَّة قَالَ الْحَافِظُ بْنُ حَجَرٍ وَتُعُقِّبَ بِأَنَّ فِي إِسْنَاده رَاوِيًا مَجْهُولًا وَعَلَى تَقْدِير الصِّحَّة فَلَا دَلِي…
