أَخْبَرَنَا الْعَبَّاسُ بْنُ الْوَلِيدِ بْنِ مَزِيدٍ، قَالَ أَخْبَرَنِي أَبِي قَالَ، حَدَّثَنَا الأَوْزَاعِيُّ، قَالَ حَدَّثَنِي الزُّهْرِيُّ، قَالَ حَدَّثَنَا عَطَاءُ بْنُ يَزِيدَ، عَنْ أَبِي أَيُّوبَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏

"‏ الْوِتْرُ حَقٌّ فَمَنْ شَاءَ أَوْتَرَ بِخَمْسٍ وَمَنْ شَاءَ أَوْتَرَ بِثَلاَثٍ وَمَنْ شَاءَ أَوْتَرَ بِوَاحِدَةٍ ‏"

Al-Awza'I said:

"Az-Zuhri narrated to me, he said: 'Ata bin Yazid, from Abu Ayyub: The Messenger of Allah (ﷺ) said: 'Witr is a duty, and whoever wants to pray witr with seven (rak'ahs), let him do so; whoever wants to pray witr with five, let him do so, whoever wants to pray witr with three, let him do so; and whoever wants to pray witr with one, let him do so.'"

قَوْله ( الْوِتْر حَقٌّ إِلَخْ ) قَدْ يَسْتَدِلُّ بِهِ مَنْ يَقُول بِوُجُوبِ الْوِتْر بِنَاء عَلَى أَنَّ الْحَقّ هُوَ اللَّازِم الثَّابِت عَلَى الذِّمَّة وَقَدْ جَاءَ فِي بَعْض الرِّوَايَات مَقْرُونًا بِالْوَعِيدِ عَلَى تَارِكِهِ وَيُجِيب مَنْ لَا يَرَى الْوُجُوب أَنَّ مَعْنَى حَقّ أَنَّهُ مَشْرُوع ثَابِت وَمَعْنَى لَيْسَ مِنَّا كَمَا فِي بَعْض الرِّوَايَات لَيْسَ مِنْ أَهْلِ سُنَّتِنَا وَعَلَى طَرِيقَتنَا أَوْ الْمُرَاد مَنْ لَمْ يُوتِر رَغْبَة عَنْ السُّنَّة فَلَيْسَ مِنَّا وَاَللَّه تَعَالَى أَعْلَمُ.…

Authentic Sunan an-Nasa'i 1704

The Prophet (ﷺ) got up at night and cleaned his teeth, then he prayed two rak'ahs, then he slept. Then he got up and cleaned his teeth, then he performed wudu and prayed two rak'ahs, until he had prayed six. Then he prayed witr with three rak'ahs, and prayed two rak'ahs.

قَامَ مِنَ اللَّيْلِ فَاسْتَنَّ ثُمَّ صَلَّى رَكْعَتَيْنِ ثُمَّ نَامَ ثُمَّ قَامَ فَاسْتَنَّ ثُمَّ تَوَضَّأَ فَصَلَّى رَكْعَتَيْنِ حَتَّى صَلَّى سِتًّا ثُمَّ أَوْتَرَ بِثَلاَثٍ وَصَلَّى رَكْعَتَيْنِ ‏.‏

Authentic Sunan Abu Dawud 1356

I spent a night with my maternal aunt Maimunah. The Messenger of Allah (ﷺ) came after the evening has come. He asked: Did the boy pray ? She said: Yes. Then he lay down till a part of night had passed as much as Allah willed; he got up, performed ablution and prayed seven or five rak'ahs, observing…
