وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ، ابْتَاعَ وَلِيدَةً فَوَجَدَهَا ذَاتَ زَوْجٍ فَرَدَّهَا .

( ش ) : قَوْلُهُ أَنَّهُ وَجَدَ الْأَمَةَ ذَاتَ زَوْجٍ فَرَدَّهَا يَقْتَضِي أَنَّ ذَلِكَ عَيْبٌ فِيهَا , وَقَدْ تَقَدَّمَ ذِكْرُهُ وَإِدْخَالُ مَالِكٍ رَحَمِهُ اللَّهُ هَذَا الْحَدِيثَ فِي هَذَا الْبَابِ بِمَعْنَى أَنَّ الزَّوْجَ يَمْنَعُ السَّيِّدَ مِنْ الْوَطْءِ وَهُوَ مِنْ بَعْضِ الْعُيُوبِ الَّتِي يُؤَثِّرُ فِيهَا الزَّوْجُ.…
