حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، أَنَّ رَجُلاً، سَأَلَ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ مَا يَحِلُّ لِي مِنِ امْرَأَتِي وَهِيَ حَائِضٌ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏

"‏ لِتَشُدَّ عَلَيْهَا إِزَارَهَا ثُمَّ شَأْنَكَ بِأَعْلاَهَا ‏"

Yahya related to me from Malik from Zayd ibn Aslam that a man questioned the Messenger of Allah, may Allah bless him and grant him peace, saying, "What is permitted me from my wife when she is menstruating?" The Messenger of Allah, may Allah bless him and grant him peace, said, "Let her wrap her waist-wrapper round herself tightly, and then what is above that is your concern."

( ش ) : قَوْلُهُ مَا يَحِلُّ لِي مِنْ امْرَأَتِي وَهِيَ حَائِضٌ وَإِنْ كَانَ لَفْظًا عَامًّا فَهُوَ خَاصٌّ بِالِاسْتِمْتَاعِ بِالْوَطْءِ لِأَنَّهُ إِذَا وَقَعَ السُّؤَالُ عَلَى عَيْنٍ مِنْ الْأَعْيَانِ انْصَرَفَ بِالْعُرْفِ وَالْعَادَةِ إِلَى الْمَنَافِعِ الْمَقْصُودَةِ مِنْ الْمَرْأَةِ الِاسْتِمْتَاعِ وَالْوَطْءِ فَكَانَ السُّؤَالُ عَلَى مَا يَحِلُّ لَهُ مِنْ وَطْئِهَا فِي حَالِ حَيْضِهَا لِمَا عَلِمَ أَنَّهُ مَمْنُوعُ مِنْ وَطْئِهَا فِي الْفَرْجِ لِقَوْلِ اللَّهِ تَعَالَى وَيَسْأَلُونَك عَنْ الْمَحِيضِ قُلْ هُوَ أَذًى فَاعْتَزَلُوا النِّسَاءَ فِي الْمَحِيضِ وَانْصَرَفَ الِاعْتِزَالُ أَيْضًا إِلَى اعْتِزَالِ وَطْءٍ لِمَا تَقَدَّمَ ذِكْرُهُ وَعَلِمَ هَذَا السَّائِلُ أَنَّ الِاسْتِمْتَاعَ بِا…

Zaid b. Aslam said that a man asked God’s messenger what was lawful for him in his wife when she was menstruating, and he replied, “She should tie her waist-wrapper on her, then you can do what you like above it.” Malik and Darimi transmitted it in mursal form.

Maimunah daughter of Al Harith said “When the Apostle of Allaah(ﷺ) intended to associate and lie with any of his wives who was menstruating, he ordered her to wrap up the lower garment(loin-cloth) and then he had association with her.

أَرَادَ أَنْ يُبَاشِرَ امْرَأَةً مِنْ نِسَائِهِ وَهِيَ حَائِضٌ أَمَرَهَا أَنْ تَتَّزِرَ ثُمَّ يُبَاشِرُهَا ‏.‏
