Chapter: One who kills a disbeliever then keeps to the right path

Authentic hadith of Sahih Muslim Sahih Muslim 1891a

Narrator:Abu Hurayrah

حَدَّثَنَا يَحْيَى بْنُ أَيُّوبَ، وَقُتَيْبَةُ، وَعَلِيُّ بْنُ حُجْرٍ، قَالُوا حَدَّثَنَا إِسْمَاعِيلُ، - يَعْنُونَ ابْنَ جَعْفَرٍ - عَنِ الْعَلاَءِ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏

لاَ يَجْتَمِعُ كَافِرٌ وَقَاتِلُهُ فِي النَّارِ أَبَدًا ‏"

It has been narrated on the authority of Abu Huraira that the Messenger Allah (ﷺ) said:

A disbeliever and a believer who killed him will never be gathered together in Hell.

Reported by Muslim (No. 1891a) and Ahmad (No. 8798).

An-Nawawi — Sharh Sahih Muslim

قَوْله صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ : ( لَا يَجْتَمِع كَافِر وَقَاتِله فِي النَّار أَبَدًا ) وَفِي رِوَايَة : ( لَا يَجْتَمِعَانِ فِي النَّار اِجْتِمَاعًا يَضُرّهُمَا قِيلَ : مَنْ هُمْ يَا رَسُول اللَّه ؟ قَالَ : " مُؤْمِن قَتَلَ كَافِرًا ثُمَّ سَدَّدَ ) قَالَ الْقَاضِي : فِي الرِّوَايَة الْأُولَى يُحْتَمَل أَنَّ هَذَا مُخْتَصّ بِمَنْ قَتَلَ كَافِرًا فِي الْجِهَاد , فَيَكُون ذَلِكَ مُكَفِّرًا لِذُنُوبِهِ حَتَّى لَا يُعَاقَب عَلَيْهَا , أَوْ يَكُون بِنِيَّةٍ مَخْصُوصَة , أَوْ حَالَة مَخْصُوصَة. وَيُحْتَمَل أَنْ يَكُون عِقَابه إِنْ عُوقِبَ بِغَيْرِ النَّار كَالْحَبْسِ فِي الْأَعْرَاف عَنْ دُخُول الْجَنَّة أَوَّلًا وَلَا يَدْخُل النَّار , أَوْ يَكُون إِنْ عُوقِبَ بِهَا فِي غَيْر مَوْضِع عِق…

No two such persons shall be together in Hell as if one of them is such that his presence hurts the other. It was asked: Messenger of Allah, who are they? He said: A believer who killed a disbeliever and (then) kept to the right path."
