حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم

رَجَمَ يَهُودِيَّيْنِ أَنَا فِيمَنْ رَجَمَهُمَا فَلَقَدْ رَأَيْتُهُ وَإِنَّهُ يَسْتُرُهَا مِنَ الْحِجَارَةِ ‏.‏

It was narrated from Ibn`Umar:

The Prophet (ﷺ) stoned two Jews, and I was among those who stoned them. I saw (the man) trying to shield (the woman) from the stones.”

Al-Sindi — Hashiyat al-Sindi on Sunan Ibn Majah

قَوْله ( رَجَمَ يَهُودِيَّيْنِ ) أَيْ أَمَرَ بِرَجْمِهِمَا ( أَنَا فِيمَنْ رَجَمَهُمَا ) أَيْ كُنْت فِي جُمْلَة مَنْ رَجَمَهُمَا ( فَلِقَدْ رَأَيْته ) أَيْ الرَّجُل ( يَسْتُرُهَا ) أَيْ الْمَرْأَة مِنْ كَمَال الْمَوَدَّة وَظَاهِر الْحَدِيث رَجْم الْكَفَرَة وَمَنْ لَا يَقُول بِهِ يَعْتَذِرُ بِأَنَّ حُكْمه صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ فِي الْحُكْم كَانَ بِالتَّوْرَاةِ عَلَيْهِمْ قُلْت فَيَجِبُ عَلَيْنَا اِتِّبَاعُهُ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ فِي الْحُكْم بِالتَّوْرَاةِ عَلَيْهِمْ بِالرَّجْمِ عَلَى أَنَّ هَذَا مُسْتَبْعَدٌ بَلْ ظَاهِر قَوْله تَعَالَى { وَإِنْ حَكَمْت فَاحْكُمْ بَيْنهمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّا جَاءَك مِنْ الْحَقِّ } الْآيَة يَقْتَضِ…
