حَدَّثَنَا الْحُسَيْنُ بْنُ أَبِي السَّرِيِّ الْعَسْقَلاَنِيُّ، وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ، قَالاَ حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا سَعِيدُ بْنُ بَشِيرٍ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏

"‏ إِذَا بَاعَ الْمُجِيزَانِ فَهُوَ لِلأَوَّلِ ‏"

It was narrated from Samurah that the Messenger of Allah (ﷺ), said:

"If two (separate) authorized persons make a sale (of the same thing), then the first transaction is the one that is valid. "

Reported by Ibn Majah (No. 2191).

Al-Sindi — Hashiyat al-Sindi on Sunan Ibn Majah

قَوْله ( إِذَا بَاعَ الْمُجِيزَانِ ) بِجِيمٍ وَمُثَنَّاة تَحْتِيَّة وَزَاي مُعْجَمَة قَالَ فِي النِّهَايَة الْمُجِيزُ الْوَلِيُّ وَالْقَيِّمُ بِأَمْرِ الْيَتِيمِ وَالصَّغِيرِ الْمَأْذُون لَهُ فِي التِّجَارَة قَوْله ( فَهُوَ لِلْأَوَّلِ ) أَيْ الْمُشْتَرِي الْأَوَّل وَلِلْبَائِعِ الْأَوَّل حِين يَنْفُذُ فِيهِ تَصَرُّفُهُ دُون تَصَرُّف الثَّانِي وَاَللَّه تَعَالَى أَعْلَم.…
