حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، حَدَّثَنَا اللَّيْثُ، قَالَ حَدَّثَنِي يَزِيدُ بْنُ أَبِي حَبِيبٍ، عَنْ أَبِي الْخَيْرِ، عَنْ عُقْبَةَ بْنِ عَامِرٍ ـ رضى الله عنه ـ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏

أَحَقُّ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ ‏"

‘Uqbah ibn ‘Āmir (may Allah be pleased with him) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) said:

"The worthiest stipulations to be fulfilled are those which make sexual intercourse lawful for you."

Reported by Al-Bukhari (No. 2721, 5151), Muslim (No. 1418), Abu Dawud (No. 2139), At-Tirmidhi (No. 1127), An-Nasa’i (No. 3281, 3282), Ibn Majah (No. 1954), Ahmad (No. 16664, 16722, 16736) and Ad-Darimi (No. 2106).

Explanation

The Prophet (may Allah's peace and blessings be upon him) points out that the most worthy stipulations to be fulfilled are those which make it lawful to enjoy a woman sexually. These are the permissible stipulations a woman asks for in the marriage contract.

Lessons

It is obligatory to fulfill the binding stipulations on one of the two spouses towards the other, except a stipulation that makes something lawful unlawful or something unlawful lawful.
Fulfillment of marriage conditions are more emphatic than others, for they are stipulated in return for making sexual intercourse lawful.
Marriage occupies a great status in Islam, as he (may Allah's peace and blessings be upon him) stressed the fulfillment of its stipulations.

Explanation in Arabic

يُبَيِّنُ النبيُّ صلى الله عليه وسلم أنَّ أولى الشروط بالوفاء هو ما كان سببًا في حِلِّ التَّمَتُّعِ بالمرأة، وهي الشروط المباحة التي تطلبها الزوجة في عقد النكاح.

وجوب الوفاء بالشروط التي التزم بها أحد الزوجين للآخر، إلا شرطًا حَرَّمَ حلالًا أو أَحَلَّ حرامًا.
الوفاء بشروط النكاح آكَدُ من غيرها؛ لأنها في مُقابل استحلال الفروج.
عظم مكانة الزواج في الإسلام، حيث أَكَّدَ على الوفاء بشروطه.
