Narrator:Ka‘b ibn Mālik

حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، سَمِعَ الْمُعْتَمِرَ، أَنْبَأَنَا عُبَيْدُ اللَّهِ، عَنْ نَافِعٍ، أَنَّهُ سَمِعَ ابْنَ كَعْبِ بْنِ مَالِكٍ، يُحَدِّثُ عَنْ أَبِيهِ، أَنَّهُ كَانَتْ

لَهُمْ غَنَمٌ تَرْعَى بِسَلْعٍ، فَأَبْصَرَتْ جَارِيَةٌ لَنَا بِشَاةٍ مِنْ غَنَمِنَا مَوْتًا، فَكَسَرَتْ حَجَرًا فَذَبَحَتْهَا بِهِ، فَقَالَ لَهُمْ لاَ تَأْكُلُوا حَتَّى أَسْأَلَ النَّبِيَّ صلى الله عليه وسلم، أَوْ أُرْسِلَ إِلَى النَّبِيِّ صلى الله عليه وسلم مَنْ يَسْأَلُهُ‏.‏ وَأَنَّهُ سَأَلَ النَّبِيَّ صلى الله عليه وسلم عَنْ ذَاكَ، أَوْ أَرْسَلَ، فَأَمَرَهُ بِأَكْلِهَا‏.‏

Narrated Ibn Ka`b bin Malik from his father:

We had some sheep which used to graze at Sala'. One of our slavegirls saw a sheep dying and she broke a stone and slaughtered the sheep with it. My father said to the people, "Don't eat it till I ask the Prophet about it (or till I send somebody to ask the Prophet)." So, he asked or sent somebody to ask the Prophet, and the Prophet (ﷺ) permitted him to eat it. 'Ubaidullah (a sub-narrator) said, "I admire that girl, for though she was a slave-girl, she dared to slaughter the sheep . "

Explanation in Arabic

روى كعب بن مالك رضي الله عنه أنه كانت له غنم ترعى في جبل بالمدينة، فرأت جارية من جواري كعب شاةً من غنمهم كادت أن تموت، فكسرت حجرًا حتى أصبح يجرح فذبحت الشاة به، فقال لهم كعب: لا تأكلوا من الشاة حتى اسأل أو أرسل إلى النبي صلى الله عليه وسلم من يسأله عن ذبح هذه الشاة، فلما سأل أو أرسل من يسأل النبي عليه الصلاة والسلام أمره أن يأكلها؛ لأن الحجر محدَّد، والذابح لا يشترط أن يكون ذكرًا.

  • تصديق الراعي والوكيل على ما اؤتمن عليه، حتى يظهر عليه دليل الخيانة والكذب.
  • جواز ذكاة النساء والإماء إذا أحْسَنَّ الذبح.
  • جواز الذكاة بالحجر المحدد.
  • جواز ذكاة ما أشرف على الموت.
  • صحة ذكاة غير المالك بغير وكالة، وبغير إذن مالكه إذا كان فيه حفظًا لماله.
  • جواز التوكيل في الاستفتاء.
  • جواز أكل المذبوح الذي أشرف على الموت إذا كان فيه حياة مستقرة قبل الذبح، وإلا فلا يجوز.
  • جواز الذبح بكل جارح إلا السن والظفر، فإنهما مستثنيان.

قَوْله : ( أَنَّهُ سَمِعَ اِبْن كَعْب بْن مَالِك ) جَزَمَ الْمِزِيُّ فِي " الْأَطْرَاف " بِأَنَّهُ عَبْد اللَّه , لَكِنْ رَوَى اِبْن وَهْب عَنْ أُسَامَة بْن زَيْد عَنْ اِبْن شِهَاب عَنْ عَبْد الرَّحْمَن بْن كَعْب بْن مَالِك عَنْ أَبِيهِ طَرَفًا مِنْ هَذَا الْحَدِيث فَالظَّاهِر أَنَّهُ عَبْد الرَّحْمَن. قَوْله : ( قَالَ عُبَيْد اللَّه ) هُوَ اِبْن عُمَر الْعُمَرِيّ رَاوِي الْحَدِيث , وَهُوَ مَوْصُول بِالْإِسْنَادِ الْمَذْكُور إِلَيْهِ. قَوْله : ( تَابَعَهُ عَبَدَة ) أَيْ اِبْن سُلَيْمَان ( عَنْ عُبَيْد اللَّه ) هُوَ الْعُمَرِيّ الْمَذْكُور بِالْإِسْنَادِ الْمَذْكُور , وَسَيَأْتِي مَوْصُولًا فِي كِتَاب الذَّبَائِح وَيَأْتِي الْكَلَام عَلَيْهِ هُنَاكَ وَنَذْكُر الِاخْتِلَاف فِيهِ عَلَى نَافِع و…

Authentic Sahih al-Bukhari 5505

A slave girl belonging to Ka`b used to graze some sheep at Sl'a (mountain). Once one of her sheep was dying. She reached it (before it died) and slaughtered it with a stone. The Prophet (ﷺ) was asked, and he said, "Eat it."

تَرْعَى غَنَمًا بِسَلْعٍ، فَأُصِيبَتْ شَاةٌ مِنْهَا، فَأَدْرَكَتْهَا فَذَبَحَتْهَا بِحَجَرٍ، فَسُئِلَ النَّبِيُّ صلى الله عليه وسلم فَقَالَ ‏"‏ كُلُوهَا ‏"

Authentic Sahih al-Bukhari 5502

that Ka`b had a slave girl who used to graze his sheep on a small mountain, called "Sl'a", situated near the market. Once a sheep was dying, so she broke a stone and slaughtered it with it. When they mentioned that to the Prophet, he, permitted them to eat it.
