حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ سَلِيمِ بْنِ حَيَّانَ، حَدَّثَنَا سَعِيدُ بْنُ مِينَا، قَالَ سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ قَالَ نَهَى النَّبِيُّ صلى الله عليه وسلم أَنْ

تُبَاعَ الثَّمَرَةُ حَتَّى تُشَقِّحَ‏.‏

Narrated Jabir bin `Abdullah:

The Prophet (ﷺ) forbade the s of (date) fruits till they were red or yellow and fit for eating.

Explanation in Arabic

لقدْ جاءتْ تَشريعاتُ الإسلامِ بأوامِرَ ونَواهٍ تَضبِطُ تَعامُلاتِ الناسِ فيما بيْنهم؛ حِفظًا للحُقوقِ، وقَطْعًا للنِّزاعِ.

وفي هذا الحَديثِ يَرْوي أنسُ بنُ مالِكٍ رَضيَ اللهُ عنه أنَّ النبيَّ صلَّى اللهُ عليه وسلَّمَ نَهى عن بَيعِ الثِّمارِ الَّتي على رُؤوسِ النَّخلِ أو الشَّجَرِ مُنفرِدةً وحْدَها حتَّى تَنضَجَ ويَطيبَ أكْلُها، ويَظهَرَ صَلاحُها وتَحمَرَّ أو تصفَرَّ؛ لأنَّه إذا احمَرَّتْ أو اصفَرَّتْ، كان ذلك عَلامةً على تَمامِ نُضوجِها. ففسَّرَ صلَّى اللهُ عليه وسلَّمَ «حتَّى تُزْهي»، بأنَّها حتى تَحمَرَّ أو تَصفرَّ، وذلك أمارةُ الصَّلاحِ فيها، ودَليلُ خَلاصِها مِن الآفةِ.

والعِلَّةُ الشَّرعيَّةُ في النَّهيِ عن بَيعِ الثِّمارِ قبْلَ نُضوجِها هي ما يَحْتوي عليه هذا البَيعُ مِن الضَّررِ والمُخاطَرةِ؛ لأنَّها قد تَتلَفُ الثَّمرةُ فيَخسَرُ المُشتري، فيُؤدِّي ذلك إلى أكْلِ أموالِ النَّاسِ بالباطِلِ؛ لاحتِمالِ حُدوثِ العاهةِ قبْلَ أخْذِها.

وفي الحديث: النهيُ عن بيْعِ الثَّمَرِ قبْلَ نُضجِه وصَلاحِه.

قَوْلُهُ : ( حَتَّى تُشْقَحَ ) بِضَمِّ أَوَّلِهِ مِنْ الرُّبَاعِيّ يُقَالُ أَشْقَحَ ثَمَرُ النَّخْلِ إِشْقَاحًا إِذَا اِحْمَرَّ أَوْ اِصْفَرَّ , وَالِاسْمُ الشُّقْحُ بِضَمِّ الْمُعْجَمَةِ وَسُكُونِ الْقَافِ بَعْدَهَا مُهْمَلَةٌ , وَذَكَرَهُ مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنْ جَابِرٍ بِلَفْظِ " حَتَّى تُشْقَهَ " فَأَبْدَلَ مِنْ الْحَاءِ هَاءً لِقُرْبِهَا مِنْهَا. قَوْلُهُ : ( فَقِيلَ وَمَا تُشْقَحُ ) ؟ هَذَا التَّفْسِيرُ مِنْ قَوْلِ سَعِيدِ بْنِ مِينَاءَ رَاوِي الْحَدِيثِ , بَيَّنَ ذَلِكَ أَحْمَدُ فِي رِوَايَتِهِ لِهَذَا الْحَدِيثِ عَنْ بَهْزِ بْنِ أَسَدٍ عَنْ سَلِيمِ بْنِ حَيَّانَ أَنَّهُ هُوَ الَّذِي سَأَلَ سَعِيدَ بْنَ مِينَاءَ عَنْ ذَلِكَ فَأَجَابَهُ بِذَلِكَ , وَكَذَلِكَ أَخْرَجَهُ مُسْلِمٌ…

Authentic Sunan Abu Dawud 3370

The Messenger of Allah (ﷺ) forbade the sale of fruits until they are ripened (tushqihah). He was asked: What do you mean by their ripening (ishqah)? He replied: They become red or yellow, and they are eaten.

أَنْ تُبَاعَ الثَّمَرَةُ حَتَّى تُشَقِّحَ ‏.‏ قِيلَ وَمَا تُشَقِّحُ قَالَ تَحْمَارُّ وَتَصْفَارُّ وَيُؤْكَلُ مِنْهَا ‏.‏

Yahya related to me from Malik from Nafi from Ibn Umar that the Messenger of Allah, may Allah bless him and grant him peace, forbade selling fruit until it had started to ripen. He forbade the transaction to both buyer and seller.
