حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا جَرِيرٌ، حَدَّثَنِي يَعْلَى، عَنْ عِكْرِمَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم ح وَحَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ وَعُقْبَةُ بْنُ مُكْرَمٍ قَالاَ حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ حَدَّثَنَا أَبِي قَالَ سَمِعْتُ يَعْلَى بْنَ حَكِيمٍ يُحَدِّثُ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ لِمَاعِزِ بْنِ مَالِكٍ ‏"‏

لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ أَفَنِكْتَهَا ‏"‏ ‏.‏ قَالَ نَعَمْ ‏.‏ قَالَ فَعِنْدَ ذَلِكَ أَمَرَ بِرَجْمِهِ ‏.‏

Narrated Abdullah ibn Abbas:

The Prophet (ﷺ) said to Ma'iz ibn Malik: Perhaps you kissed, or squeezed, or looked. He said: No. He then said: Did you have intercourse with her? He said: Yes. On the (reply) he (the Prophet) gave order that he should be stoned to death. The narrator did not mention "on the authority of Ibn 'Abbas". This is Wahb's version.

Reported by Abu Dawud (No. 4427), Al-Bukhari (No. 6824) and Ahmad (No. 2307, 2486).

( حَدَّثَنَا مُوسَى بْن إِسْمَاعِيل أَخْبَرَنَا جَرِير حَدَّثَنِي يَعْلَى عَنْ عِكْرِمَة أَنَّ النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ ) : هَذِهِ الرِّوَايَة مُرْسَلَة وَرِوَايَة وَهْب بْن جَرِير مَوْصُولَة قَالَ الْحَافِظ لَمْ يَذْكُر مُوسَى فِي رِوَايَته اِبْن عَبَّاس بَلْ أَرْسَلَهُ , وَأَشَارَ إِلَى ذَلِكَ أَبُو دَاوُدَ وَكَأَنَّ الْبُخَارِيّ لَمْ يَعْتَبِر هَذِهِ الْعِلَّة لِأَنَّ وَهْب بْن جَرِير وَصَلَهُ وَهُوَ أَخْبَر بِحَدِيثِ أَبِيهِ مِنْ غَيْره وَلِأَنَّهُ لَيْسَ دُون مُوسَى فِي الْحِفْظ ; وَلِأَنَّ أَصْل الْحَدِيث مَعْرُوف عَنْ اِبْن عَبَّاس فَقَدْ أَخْرَجَهُ أَحْمَد وَأَبُو دَاوُدَ , وَمِنْ رِوَايَة خَالِد الْحَذَّاء عَنْ عِكْرِمَة عَنْ اِبْن عَبَّاس وَأَخْرَجَهُ مُسْلِم مِنْ…

When Mā‘iz ibn Mālik came to the Prophet (may Allah's peace and blessings be upon him) (in order to confess adultery), the Prophet (may Allah's peace and blessings be upon him) said to him: Probably you have only kissed, winked, or looked (at the lady)? Jabir said that a man committed fornication with a woman and the Prophet gave command that he be given the appropriate beating, but on being told afterwards that the man was married he gave command that he should be stoned to death. Abu Dawud transmitted it.
