حَدَّثَنَا أَبُو كَامِلٍ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا خَالِدٌ، - يَعْنِي الْحَذَّاءَ - عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ مَاعِزَ بْنَ مَالِكٍ، أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ إِنَّهُ زَنَى ‏.‏ فَأَعْرَضَ عَنْهُ فَأَعَادَ عَلَيْهِ مِرَارًا فَأَعْرَضَ عَنْهُ فَسَأَلَ قَوْمَهُ ‏"‏ أَمَجْنُونٌ هُوَ ‏"‏ ‏.‏ قَالُوا لَيْسَ بِهِ بَأْسٌ ‏.‏ قَالَ ‏"‏ أَفَعَلْتَ بِهَا ‏"‏ ‏.‏ قَالَ نَعَمْ ‏.‏

فَأَمَرَ بِهِ أَنْ يُرْجَمَ فَانْطُلِقَ بِهِ فَرُجِمَ وَلَمْ يُصَلِّ عَلَيْهِ ‏.‏

Narrated Abdullah ibn Abbas:

Ma'iz ibn Malik came to the Prophet (ﷺ) and said that he had committed fornication and he (the Prophet) turned away from him. He repeated it many times, but he (the Prophet) turned away from him. He asked his people: Is he mad? They replied: There is no defect in him. He asked: Have you done it with her? He replied: Yes. so he ordered that he should be stoned to death. He was taken out and stoned to death, and he (the Prophet) did not pray over him.

( فَسَأَلَ قَوْمه أَمَجْنُون هُوَ ) : وَفِي حَدِيث جَابِر مِنْ طَرِيق الزُّهْرِيّ عَنْ أَبِي سَلَمَة عَنْهُ فَقَالَ لَهُ النَّبِيّ صَلَّى اللَّه عَلَيْهِ وَسَلَّمَ " أَبِكَ جُنُون " وَيُجْمَع بَيْنهمَا بِأَنَّهُ سَأَلَهُ ثُمَّ سَأَلَ عَنْهُ قَوْمه اِحْتِيَاطًا فَإِنَّ فَائِدَة سُؤَاله أَنَّهُ لَوْ اِدَّعَى الْجُنُون لَكَانَ فِي ذَلِكَ دَفْع لِإِقَامَةِ الْحَدّ عَلَيْهِ حَتَّى يَظْهَر خِلَاف دَعْوَاهُ , فَلَمَّا أَجَابَ بِأَنَّهُ لَا جُنُون بِهِ سَأَلَ عَنْهُ قَوْمه لِاحْتِمَالِ أَنْ يَكُون كَذَلِكَ وَلَا يَعْتَدّ بِقَوْلِهِ كَذَا جَمَعَ الْحَافِظ بَيْن الرِّوَايَتَيْنِ ( فَانْطُلِقَ ) : بِصِيغَةِ الْمَجْهُول ( بِهِ ) : الْهَاء لِلتَّعْدِيَةِ ( فَلَمْ يُصَلِّ ) : أَيْ النَّبِيّ صَلَّى اللَّه…

Jabir said that a man committed fornication with a woman and the Prophet gave command that he be given the appropriate beating, but on being told afterwards that the man was married he gave command that he should be stoned to death. Abu Dawud transmitted it.
